For the first time since 2003, Texas has amended the "futility" provisions in the Texas Advance Directives Act. Both the Texas House and Senate passed H.B. 3074. It was sent to the Governor on Friday. Once effective, this legislation exempts clinically assisted nutrition and hydration from the scope of life-sustaining treatment subject to Tex. Health & Safety Code 166.046.
